If you have been injured in Virginia as a result of the negligence of another, you are entitled to be compensated for your injuries, damages and losses, provided you timely file suit and your injuries, damages and losses were not caused by your own contributory negligence.
Contributory negligence
Virginia is one of the few jurisdictions that still bars recovery if the injured person was even slightly at fault. Insurers know it, and they build their defense around it.
Two-year deadline
Most personal injury suits must be filed within two years (Va. Code § 8.01-243(A)). A wrongful death action must be filed within two years of the death (§ 8.01-244(B)).
Shorter notice deadlines against government
Negligence claims against a county, city, or town generally require written notice within six months (§ 15.2-209); claims against the Commonwealth within one year (§ 8.01-195.6).
Punitive damages for drunk drivers
Virginia law allows punitive damages against an intoxicated driver whose conduct meets the statutory test (§ 8.01-44.5).

- Preserve evidence: photographs, damaged property, names of witnesses, and any video.
- Do not give a recorded statement to the other side’s insurer, and do not sign releases or medical authorizations, before speaking with a lawyer.
